Attorney Joseph Price Completes Term as President of Lackawanna Bar Association
DLP Wins $14.5 Million Settlement
Dougherty, Leventhal and Price personal injury Attorneys Patrick E Dougherty, Joseph G. Price and Paul T. Oven settled a motor vehicle accident case against a paving company winning $14.5 million for their client. The client sustained traumatic injuries in the one car crash.
The client turned out of a driveway and traveled about a half mile when the passenger side tires left the road and dropped six inches in an open and exposed dirt shoulder. Traveling at about 45 mph, the tires ran along the dirt shoulder. The client then over-steered the vehicle back into the road, yawed and then struck two trees. The impact of the crash nearly threw the plaintiff through the rear window.
The paving company contracted with the Pennsylvania Department of Transportation to pave and shoulder more than 40 miles on a number of roads.
Shouldering and paving is a process whereby the edges of the road are prepared and two layers of surface are laid. Afterward, steps are to be taken to immediately restore the shoulders of the road or to protect or warn the public about the open road edge and drop off.
Despite completing the edge and paving work, the paving company did not shoulder the road or protect or warn the public about it at any time prior to completing the shoulder work.
Now a quadriplegic, the client spent months in various hospitals for intensive physical therapy and rehabilitation. A life care plan was prepared outlining the extensive costs associated with future medical care and medical management. The client is now at home under 24 hour care.
DLP Secures $1.96 Million Award For Couple
A Nanticoke couple has been awarded $1.96 million in a verdict returned by a Luzerne County jury against the Tennessee corporation that operates Dollar General stores. The couple, Joan and Jay Urbanski, was represented by personal injury Attorneys Patrick Dougherty, Joseph Price and Brian Walsh of the DLP law firm. Attorney Price believes the verdict to be a record in Luzerne County for that type of case. It also could go higher as a motion has been filed seeking delay damages against Dollar General.
Mrs. Urbanski, 40, was injured in the fall at a Dollar General Store in Hanover Township on Sept. 4, 2000. She fell after stepping on transparent plastic packaging material that had been left in the store aisle. The jury determined Mrs. Urbanski, a nurse, should receive $862,000 for economic damages, including lost income and the costs of ongoing medical treatment, and $1 million in punitive damages. Her husband was awarded $100,000 for loss of companionship. Dollar General admitted negligence relative to Mrs.Urbanski’s fall, but disputed the extent of her injuries and the diagnosis of reflex sympathetic dystrophy, a nerve disorder resulting from the fall, which disables Mrs. Urbanski. Mr. Price said the case and verdict have a component of deterrence. Attorney Price noted :”We wanted to tell this Tennessee corporation that, if they’re going to have outlets and make profits from people in Northeastern Pennsylvania, then they need to operate safe stores”.
Jury Awards Driver $693,000.00 Against GMC
A Lackawanna County Jury decided that General Motors Corp. owes a Scranton man $693,000.00 as a result of a motor vehicle accident.
The plaintiff, John Lance, suffered injuries after crashing into a tree while pulling into a driveway. Legal papers filed by personal injury Attorney Joseph Price of the DLP Law Firm alleged that the accident resulted from an improperly installed crank shaft on the plaintiff’s Chevrolet vehicle. The crash resulted in injuries throughout Mr. Lance’s spine that prevented him from working for several years.
The jury award granted $620,000.00 to Mr. Lance for pain and suffering. The remainder of the award was for medical expenses and lost wages.
The Complaint stated that the steering failed because a bolt in the crank shaft’s pulley broke causing the pulley and the harmonic balancer to fall from the front of the engine. A report prepared by General Motors subsequent to the accident appeared to confirm this contention. Attorney Price indicated “The jury was able to decide from the facts presented that there was an obvious flaw with the vehicle. This flaw caused severe injury to my client. I’m pleased that the jury saw this for what it was and issued a verdict in favor of Mr. Lance”.
$565,000.00 Verdict in Favor of Plaintiff in Wheelchair Fall Case
A Lackawanna County Court jury awarded $565,000.00 to a Plains Township woman who was injured in a fall from a wheelchair at the Clarks Summit State Hospital. The plaintiff, Ana Dembroski, was represented by Attorney Joseph Price from the DLP Law Firm. A three part verdict awarded Mrs. Dembroski. $435,000.00 for pain and suffering, $24,000.00 for medical bills, and $106,000.00 to Mrs. Dembroski’s husband for loss of consortium.
The jury found that the fall broke the plaintiff’s left arm, torn her rotator cuff and aggravated pre-existing conditions in her neck and lower back.
The accident occurred when the Dembroskis were at the hospital to visit a patient. They were told use a rear entrance because the elevator was out of operation.
“I am proud to represent people like the Dembroskis” commented Attorney Price, “It’s what we do here at DLP. I’m happy that the jury was able to recognize the obvious negligence in this case and provide my client with a fair and proper award”.
Attorney Joseph Price, DLP, Honored for Service to 9/11 Victims
Pennsylvania personal injury attorney Joseph Price was recently honored for outstanding service to individuals and families who sought compensation under the 9/11 Victim Compensation Fund. Attorney Price was one of the first lawyers from Pennsylvania to volunteer to represents victims of the 9/11 attack. Attorney Price attended training sessions offered by the New York Trial Bar conducted in New York City. Attorney Price was assisted by fellow DLP attorneys Judy Price, Brian Walsh and John Finnerty in representing several families before the Fund administrators. The efforts of Attorney Price and his fellow attorneys resulted in several awards for their clients all in excess of one million dollars. The efforts of the lawyers at DLP and other volunteer lawyers made through Trial Lawyers Care resulted in the largest pro bono service program in the history of the United States of America, providing free legal representation to more than 1700 victim families.
