Pittsburgh City Council has introduced a resolution opposing the suppression of local zoning laws found in the newly passed natural gas drilling law, Act 13. Stating that the law takes away the rights of local municipalities to govern land use in their communities, and futher noting that the new “impact fee” law usurps the “moral and legal obligations of municipalities to protect the health, safety and welfare of residents”, Council joined in supporting the seven (7) towns who filed suit to stop the zoning provisions from taking affect. Under Act 13 local zoning laws are restricted from zoning out location of gas drilling wells and rigs within town borders. The Commonwealth Court is considering the case.
