Is A Pedestrian Riding A Bicycle That Is Struck By A Negligent Truck Driver Considered Full Tort Or Limited Tort?

Your son was injured when a negligent truck driver ran into him while he was riding his bicycle.  You have limited tort insurance coverage which precludes you and your family members from recovering non-economic damages, i.e., pain and suffering damages, when your injuries result from a motor vehicle accident.  Is your son entitled to recover damages for his pain and suffering?

If you or a family member are injured while a pedestrian, your selection of limited tort insurance coverage is of no consequence.  Pedestrians whose auto insurance coverage is limited tort are deemed to have the same right of recovery of damages as someone who had selected full tort coverage.  Even though riding a bicycle at the time he was injured, your son is still deemed a pedestrian.  Therefore, if a negligent truck driver struck your son while he was riding his bicycle, your son is deemed full tort and he entitled to recover damages for his pain and suffering
