If You Are Injured In A Hit And Run Accident, You May Still Be Able To Recover Damages

With the tragic hit and run accident that occurred in Wilkes-Barre, PA last week still fresh in our minds, some people may be wondering if the boy’s family has any recourse to recover damages for his injuries.  If the hit and run driver is identified, the family could obviously pursue a claim to recover damages against the driver and his insurance company.  Unfortunately, their recovery against the driver and his insurance company would likely be limited to the amount of insurance coverage the driver has on his auto insurance policy.  However, if the boy’s family has underinsured motorist (UIM) coverage on their own auto insurance policy, they could also recover those UIM benefits up to the policy limits.
