If I Loan My Car To My Brother, Does My Insurance Coverage Apply?

Generally, if you loan your vehicle to someone to drive it on a limited basis, your insurance coverage will protect the driver to whom you lent the vehicle.  However, there are some scenarios where your insurance company may deny coverage.  For example, if the person to whom you lent the vehicle is specifically listed on your policy as an “excluded driver”, then no coverage will be afforded.  Additionally, if a person took your vehicle without your permission and then caused an accident, your insurance company will likely not provide any protection to that driver.  Your insurance policy provisions will dictate whether insurance coverage is or is not applicable when someone else is driving your vehicle.  Accordingly, you should become  familiar with your insurance policy provisions regarding this issue before lending your vehicle to anyone.  If you have any questions regarding your policy, ask your agent and/or call an attorney at Dougherty, Leventhal & Price, L.L.P. (DLP) for a free consultation.
