I Was Seriously Injured In A Truck Accident, Who Pays My Lost Wages?

Posted by John Finnerty & filed under Areas of Practice, Auto Accidents, DLP Law, Insurance Disputes, Motorcycle Accidents, Serious Injury, Truck Accidents, Workers Compensation.

If you are seriously injured in truck accident, your first source of recovery for your lost wages is your own auto insurance policy.  However, you may not have income loss coverage on you auto insurance policy as it is an optional coverage.  If you have income loss coverage, you must exhaust this coverage from your own auto insurer before seeking any recovery from any other source.  If you do not have any income loss coverage on your auto insurance policy, you could recover your lost wages against the driver (and his insurer) of the vehicle that caused the accident.  However, if the accident was your fault, you will not have any source of recovery of your lost wages unless you have an employer-sponsored or a private disability insurance policy.

If your accident was work-related, you can disregard the preceding paragraph as income loss sustained as a result of a work-related accident is the responsibility of your employer’s workers’ compensation insurance carrier.
