Can I Assert A Damage Claim Against My Spouse If His Negligence Caused An Auto Accident That Resulted In Me Being Seriously Injured?

Hopefully, you are never involved in a motor vehicle accident.  However, if you are a passenger in a vehicle being driven by your spouse and your spouse’s negligence causes an accident that results in you being seriously injured, you could assert a claim for damages against your spouse and his auto insurance company.  Most likely, you do not want to collect any damages directly from your spouse because you would essentially be paying yourself.  However, you can make a claim against his auto insurance carrier for damages even if you are also listed as a named insured on the same auto insurance policy.  This is true even if you and your spouse are happily married.  The fact that you make such a claim should not have any bearing on your relationship with your spouse because you are really only going after your spouse’s insurance coverage, not him personally.
