In Pennsylvania, when you purchase an auto insurance policy, you are required to select either full tort or limited tort coverage. If you select full tort, you maintain your right to pursue a claim for non-economic (pain & suffering) damages if you are injured in a motor vehicle accident. However, if you selected limited tort coverage, in the absence of a few limited exceptions, you waive your right to recover non-economic damages (pain & suffering) if you are injured in a motor vehicle accident. Of course, you will pay higher premiums if you select full tort coverage. Nonetheless, based on some of the injured people I have represented, I believe paying the higher premium for full tort insurance coverage is well worth the investment. Regardless of your tort selection, you can always recover the economic damages you suffer as a result of a motor vehicle accident against the party responsible for causing the accident (and/or his insurance auto carrier).
If you are injured as a result of being struck by a motor vehicle while crossing a street in Pennsylvania, your tort selection is irrelevant. Pedestrians struck by motor vehicles can recover non-economic (pain & suffering) damages regardless of their tort selection on their auto insurance policy.
